RULE DEVELOPMENT FOR: Chapter 62B-33,
BUREAU OF BEACHES AND COASTAL SYSTEMS -
RULES AND PROCEDURES FOR COASTAL CONSTRUCTION AND EXCAVATION (PERMITS
FOR CONSTRUCTION SEAWARD OF THE COASTAL CONSTRUCTION CONTROL LINE AND
FIFTY-FOOT SETBACK)
The Department of Environmental Protection
has published a notice of rule development for 62B-33 Rules and
Procedures for Coastal Construction and Excavation, in the Florida
Administrative Weekly on January 29, 2010.
The proposed amendment will clarify and
update existing rule language to current procedures for exemptions,
siting policies, sea turtle lighting criteria, survey requirements,
permit time limits and extensions, general permit conditions,
definitions, forms, and fee language. This amendment will also revise
language for consistency with recent modifications to the Florida
Building Code or repeal section for structural design requirements.

Chapter 62B-36, Beach Management Assistance
Program, Florida Administrative Code.
The Florida
Department of Environmental Protection, Bureau of Beaches and Coastal
Systems, proposes amendments to Chapter 62B-36, F.A.C., in order to
implement the new inlet management priorities and procedures set forth
in Section 161.143, F.S., and make other changes to improve program
implementation. Further, the amendments to the Chapter will incorporate
recommendations made by the Beach Management Working Group. The Notice
of Rule Development and workshops, as well as the draft proposed rule

Beach Management Working Group
Proviso
language in the Fiscal Year 2008-09 General Appropriations Act, Specific
Appropriation 1748, called for the creation of a working group (Working
Group) to review the effectiveness of Florida’s beach management
program, pursuant to Chapter 161, Florida Statutes. The Working Group
was appointed by DEP Secretary Michael W. Sole to carefully examine the
current planning, permitting, monitoring and mitigation processes used
by the DEP. The Working Group has made recommendations for statutory
changes to be considered by the Legislature, and administrative rule and
process changes to be considered by the DEP. To read the final report

WALTON COUNTY COASTAL CONSTRUCTION CONTROL LINE
REESTABLISHMENT INFORMATION:
Rule
62B-26.001, Florida Administrative Code (F.A.C.) that provides the legal
description of the Coastal Construction Control Line (CCCL) in Walton
County, has been amended. The amended rule became effective August 25,
2009. The Department of Environmental Protection (Department) is
now exercising permitting jurisdiction seaward of the newly
reestablished line. For permitting information please refer to our
CCCL Program.
This
process was the
direct result of the severe hurricane activity during the 2004 and 2005
seasons. The Florida Department of Community Affairs’ Coastal High Hazard
Study Committee’s report, dated February 1, 2006, recommended that the
Department restudy the CCCL’s
along identified portions of the Florida Panhandle and reestablish the
line(s) as necessary in order to protect life, property, and the beach
and dune system.
A priority
was placed on CCCL’s based on the degree of anticipated change of the
line and the degree of development potential within the area that may be
added seaward of the reestablished line. This report can be reviewed by

A comprehensive engineering study was
completed in Walton County that resulted in a recommendation for the

RULE DEVELOPMENT:
As mentioned above the coastal
construction control line is adopted by rule and is entitled
Chapter 62B-26.016, F.A.C., Description of the Gulf County
Coastal Construction Control Line. The DEP initiated
rule development to made proposed amendment to this rule and
published a "Notice of Proposed Rule Development" in the
Florida Administrative Weekly (FAW) on February 9, 2007.
